General Terms and Conditions for Check Regulations

1. General
1.1 These General Terms and Conditions apply to all agreements and deliveries from Check Regulations, located at Marsstraat 17, 2024GA Haarlem, registered with the Chamber of Commerce under number 95234780, regarding the sale and delivery of online templates via our website www.checkregulations.com.
1.2 By placing an order on our website, the buyer agrees to these General Terms and Conditions.
2. Services
2.1 Check Regulations offers online checklists that provide guidance to help the buyer comply with specific law and/or regulations.
2.2 The checklists are solely designed as tools and provide a basis that the buyer can adjust and/or use according to their specific situation, at their own discretion and responsibility.
2.3 Check Regulations does not guarantee that using the checklists will automatically make the buyer fully compliant with the specific law or regulation.
3. Prices and Payments
3.1 All prices on the website are listed in euros and exclude VAT unless otherwise stated.
3.2 Payment must be made through the payment options provided on the website.
3.3 Check Regulations reserves the right to change prices and offers without prior notice.
4. Delivery
4.1 After receiving payment, the purchased product is delivered directly in digital form via a download link or by email.
4.2 The buyer is responsible for downloading and saving the product.
5. Liability
5.1 All checklists and products are provided "as is," without any express or implied warranty of compliance with applicable laws and regulations. Check Regulations accepts no liability for any direct, indirect, incidental, or consequential damages resulting from the use of the checklists. This includes, but is not limited to:

Errors, imperfections, or outdated information in the checklists;

Non-compliance with laws or regulations through the use of the checklists;

Decisions, actions, or omissions by the buyer arising from the use of the checklists.
5.2 The buyer acknowledges that Check Regulations is not a legal or professional service provider and that the checklists are not a substitute for legal or professional advice. Check Regulations does not provide legal advice in any form, and the checklists should not be considered as such. It is the buyer's responsibility to seek professional advice if necessary and to review and adapt the checklists to their own situation.
5.3 The checklists are intended solely as a general tool for the buyer to possibly comply with relevant regulations. Check Regulations does not guarantee that the checklists are suitable for a specific situation, complete, accurate, error-free, or up-to-date. Check Regulations makes no guarantee that using the checklists will result in compliance with any law or regulation.
5.4 Use of the checklists is entirely at the buyer's own risk. The buyer acknowledges that they are fully responsible for the use, adaptation, and interpretation of the checklists, and for achieving compliance with relevant laws and regulations. Check Regulations is not liable for any decisions, actions, or omissions of the buyer based on the use of the checklists, nor for the outcomes thereof.
5.5 Check Regulations is not liable for any form of indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of revenue, loss of profit, loss of opportunities, loss of data, business interruption, or reputational damage, even if such damages arise from a situation where Check Regulations has been informed of the possibility of such damages.
5.6 In the event that Check Regulations, despite the above exclusions, is held liable, the total liability of Check Regulations to the buyer, regardless of the legal basis, will never exceed the amount the buyer has actually paid for the checklists that gave rise to the liability.
5.7 Check Regulations is not liable for the unavailability of the website or the inability to download the checklists, nor for technical problems or malfunctions of any kind.
5.8 The buyer indemnifies Check Regulations against all third-party claims arising from the buyer’s use of the checklists. Use of the checklists by third parties is entirely at the risk and responsibility of the buyer.
6. Intellectual Property
6.1 All intellectual property rights related to the checklists and other materials made available through the website remain the property of Check Regulations.
6.2 The buyer is not permitted to copy, distribute, or otherwise commercially exploit the checklists without prior written permission from Check Regulations.
7. Right of Withdrawal
7.1 Since the products are digital and delivered immediately after purchase, the buyer expressly waives their right of withdrawal from the moment of delivery.
7.2 Refunds are not possible after receiving the digital products.
8. Changes to the General Terms and Conditions
8.1 Check Regulations reserves the right to change these General Terms and Conditions at any time.
8.2 Any changes will take effect from the moment they are published on the website.
9. Complaints Procedure
9.1 Check Regulations has an adequately publicized complaints procedure and handles complaints in accordance with this procedure.
10. Applicable Law
10.1 These Check Regulations are governed exclusively by Dutch law.
